In 1969, the Town of Republic passed ordinance 180, making "driving while intoxicated" (DWI) within the town of Republic a criminal offense. This ordinance adopted by reference the state statute, RCW 46.61.506,*fn1 which created a presumption that a person with a .10 percent or greater blood alcohol content was under the influence of intoxicating liquor, but provided for a discretionary jail sentence.
